1. Agreement to Terms
Welcome to The Kiff Store. These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Service") operated by The Geek Network (Pty) Ltd ("Company", "we", "us", "our"), a company registered in South Africa.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
By using the Service, you represent and warrant that you meet all eligibility requirements.
3. Your Account
3.1 Account Creation
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Account Security
You agree to:
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Not share your account with others
- Not create multiple accounts
3.3 Account Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.
4. Products and Orders
4.1 Product Information
We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product information is error-free. Colors may appear differently on your screen.
4.2 Pricing
All prices are displayed in South African Rand (ZAR) unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors.
4.3 Fixed Price Model
The Kiff Store operates on a fixed-price model where products are offered at competitive prices. Prices include applicable fees but exclude customs duties which are the buyer's responsibility.
4.4 Order Acceptance
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is only confirmed when you receive an order confirmation email or notification.
4.5 Order Cancellation
You may request to cancel an order before it ships. Once shipped, the order cannot be cancelled but may be returned per our Returns Policy.
5. Payment
5.1 Payment Methods
We accept payments through:
- Sdpkt Wallet: The Geek Network's integrated digital wallet
- Card Payments: Via our secure payment processor
- EFT: Electronic Funds Transfer (South African banks)
5.2 Payment Processing
All payments are processed securely. By providing payment information, you authorize us to charge the specified amount for your order.
5.3 Failed Payments
If a payment fails, your order will not be processed. You will be notified to provide alternative payment details.
6. Shipping and Delivery
6.1 Shipping Regions
We ship to all 16 SADC member countries. Shipping availability and times vary by location.
6.2 Delivery Times
Estimated delivery times:
- South Africa: 5-10 business days
- Neighboring Countries (Botswana, Namibia, Lesotho, Eswatini): 10-15 business days
- Other SADC Countries: 15-25 business days
These are estimates and may vary based on customs processing, local delivery services, and other factors beyond our control.
6.3 Customs and Import Duties
International orders may be subject to customs duties, taxes, or fees imposed by the destination country. These charges are the buyer's responsibility and are not included in the product price.
6.4 Risk of Loss
Risk of loss and title pass to you upon delivery to the shipping carrier. However, we will assist with claims for lost or damaged packages.
7. Returns and Refunds
7.1 Return Policy
We offer a 30-day return policy for most items. To be eligible for a return, items must be:
- Unused and in original condition
- In original packaging with tags attached
- Accompanied by proof of purchase
7.2 Non-Returnable Items
Certain items cannot be returned:
- Perishable goods
- Personal care items
- Customized or personalized products
- Downloaded digital products
- Items marked as final sale
7.3 Return Process
To initiate a return, contact us through the Help Center. We will provide return instructions and, where applicable, a return shipping label.
7.4 Refunds
Approved refunds will be processed to your Sdpkt wallet within 5-7 business days. Wallet refunds can be used for future purchases or withdrawn to your bank account.
7.5 Defective Products
For defective or damaged products, please contact us within 7 days of delivery. We will arrange a replacement or full refund including shipping costs.
8. Intellectual Property
All content on the Service, including text, graphics, logos, images, and software, is the property of The Geek Network or its licensors and is protected by intellectual property laws.
You may not:
- Copy, reproduce, or distribute our content without permission
- Modify, adapt, or create derivative works
- Use our trademarks without authorization
- Scrape, crawl, or data-mine the Service
9. Prohibited Uses
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Submit false, misleading, or fraudulent information
- Engage in fraudulent transactions
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Service
- Upload malicious code or viruses
- Harass, abuse, or harm others
- Use the Service for any illegal purpose

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Results from using the Service will be accurate or reliable
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GEEK NETWORK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your data
- Any other matter relating to the Service
Our total liability shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Geek Network and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
13. Dispute Resolution
13.1 Informal Resolution
Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@thegeeknetwork.co.za.
13.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
13.3 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts of South Africa for the resolution of any disputes.
13.4 Consumer Protection
These Terms do not limit any rights you may have under the Consumer Protection Act 68 of 2008 of South Africa or other applicable consumer protection laws.
14. The Geek Network Ecosystem
The Kiff Store is part of The Geek Network ecosystem of services. By using The Kiff Store, you may also interact with:
- Sdpkt: Digital wallet for payments and rewards
- TrustSeal: Identity verification services
- Other Network Services: As they become available
Your use of these services may be subject to additional terms and conditions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
